UndiMalaysia! - The Rakyat Guides

Dear all, 

One of the main initiatives of the MyConstitution campaign for the past two years was to produce a series of simplified 'guides' on the Federal Constitution, known as The Rakyat Guides (RG).

On 02 April 2011, the last RG was released, completing the series of 9 booklets. The complete set goes for RM6.00 per set as contribution to the cost of printing the booklets. It is not for profit.

The booklets are available at the Bar Council and State Bar Committees, as well at certain events participated by the Committee. We are also working towards trying to make the booklets available at bookshops throughout the country.

Soft-copies of the booklets are available online. Of course, the hard copies are much nicer!

PENEBANGAN POKOK KELAPA DI SEPANJANG MONSUN DRAIN SS14, SS18 DAN SS15 (MASJID DARUL EHSAN)


Sejarah penanaman pokok-pokok kelapa di lokasi sepanjang monsun drain SS14 (Jalan SS14/6M, 14/5J, 14/8 dan 14/7), SS18 (SS18/4G dan 18/5) dan sekitar Masjid Darul Ehsan Subang Jaya (SS115/1A) adalah pada tahun 1997 ketika Majlis Daerah Petaling lagi. Oleh kerana kerana timbulnya banyak aduan berkaitan buah kelapa yang jatuh ke atas kereta penduduk, pendekatan menanam pokok-pokok Swietenia Mahogany dan Pokok Tanjung ditanam dicelah-celah pokok kelapa tersebut sebagai menggantikan pokok-pokok kelapa tersebut telah diambil (sulaman). Pokok kelapa tersebut akan ditebang apabila Swietenia Mahogany dan Pokok Tanjung cukup matang.

Tahun 2012, pihak Bahagian Landskap telah merancang untuk menebang pokok kelapa tersebut. Kerja penebangan awal yang terlibat adalah disekitar monsun drain yang dijangka dimulakan pada 23/7/12 oleh kontraktor tahunan. Oleh itu, diharap pihak yang terbabit maklum akan keputusan ini.

Prasarana Tree Replanting

The following is the preliminary plan for tree re-planting by Prasarana. For every tree that Prasarana cuts to make way for the LRT project, they have to replant 10. I am pushing for MPSJ to produce the following in more detail, including plotting these trees on a map for residents information and feedback. 

I am also trying to push for the planting of shady trees, such as flame of the forest or rain trees along the main roads - in Zone 1, it would be Persiaran Jengka. I think this goes a long way towards beautifying our town. However, there are concerns that the roots will damage the road and drains, and the matter is not decided yet.

Pasar Ramadhan @ SS18


The locations of Pasar Ramadan in Subang Jaya has always raised objections every year, especially the one is SS18 & USJ4 (USJ1 & USJ7 escapes such level of complaints). The objections arise especially from the neighboring houses, which is very understandable. The complaints revolve around to traffic congestion, parking congestion, smoke from the cooking, & rubbish left over. This year, we have to also contend with the the on-going LRT construction.

As a councillor, this is one of the harder cases to handle, as unlike potholes or broken playground equipment, there is no clear answer that will satisfy all. All these issues have been discussed at length in MSPJ, and the approval to set up the Pasar Ramadan was certainly not taken lightly.

Pasar Ramadan is very popular among the residents, and arguably has been for a very long time part of our traditions and way of life. A simple google search on "Pasar Ramadan" will yield so many results of blog post and forum comments demonstrating that fact.

Unfortunately, unlike some other townships, Subang Jaya is very "built-up", leaving very little open space suitable for this Pasar Ramadan. I recall in some other areas, it is held in Stadium car parks, among other places, which are not near houses. But such locations are not to be found in Subang Jaya.

The next best thing to do (also considering that Pasar Ramadan has been in Subang Jaya as far back as I can remember), is to manage the situation, to mitigate all inconveniences to the nearby houses. For the case of SS18, the Pasar Ramadan is still maintained there for the features where are yet to be identified elsewhere within the SS12-SS19 area, namely:

  • The stretch of stalls must not prevent access to any homes, i.e. are there alternative roads to access the houses
  • Availability of parking places (yes, admittedly there will never be sufficient "parking boxes", but the impact of overflow of parking should not grind traffic to a complete halt and minimize impact to overall traffic circulation. Thus, proximity to a underutilized main road like Persiaran Jengka between SS14/SS18 helps.
  • The activities should not, if possible affect the traffic flow on Persiaran Kewajipan & Persiaran Tujuan, as this road at critical during the evening rush hour.   

In the last couple of weeks, I have had discussions with both MPSJ and Prasarana on measures to mitigate traffic and parking issues, namely (do also refer to the diagram below)

  1. The reduction of stalls this year (from 200+ to 184 this year), and its relocation towards SS18/1...
  2. freeing up the circulation around the Padang, to enable more cars to park and move around the padang (not inside the padang!)
  3. Enforcement officers will be placed on the 4 residential streets to ensure proper parking.
  4. A total of 15 traffic enforcement officers will be placed around the area to help ensure proper parking and traffic flow.
  5. Prasarana will open at least 3 openings in the construction barriers for safe crossing from SS14 to SS18
  6. Prasarana will also ensure at least 2 lanes be open at all times, and where possible more than 2 lanes to facilitate traffic
  7. Prasarana has also committed to doing "Water spray" in the area before the stall set up everyday to minimize dust effects on the Pasar Ramadan. 
Hannah Yeoh & myself have also done a press conference today on this issue, and we do ask for the cooperation of all visitors to the Pasar Ramadan to cooperate with MPSJ's enforcement officers, and to not park indiscriminately. 






Grand Dorsett (Dorsett Place Waterfront Development) & Service Apartments

I am writing this post to clarify my personal stand on Dorsett Place Waterfront Development, that is one of the hottest issues in the spotlight in Subang Jaya. 


For those who are not familiar with the background of this, you can refer to the article extracted from the Selangor Times below. 


The crux of the issue is this: Under the development order (KM by the Malay acronym), Mayland (the developer) is allowed to build and renovate 1,989 units of hotel suites as an extension of their hotel in SS12.  But residents and councillors have objected to the development after the developer advertised to sell these units as serviced apartments.


MPSJ has twice in the past rejected their application to build service apartments. The rejection is particularly clear in the 2nd rejection, where it is stated in Borang C2, the reasons for rejection, is "no service apartments is allowed".


My personal position on the matter is that the spirit of the approval must be upheld. The transformation of hotel suites (noted in their application is stated at 1989 bilik) to the current service apartments (as even derived from their sales material http://www.iproperty.com.my/developments/2403/Dorsett_Place_Waterfront/) must be stopped and reversed. 


I have spoke up on this matter in the MPSJ June full board meeting (my first full board meeting after making a comeback to MPSJ) i raised this matter at length, as covered by press. I also have pushed (successfully) that all further ancillary applications, like the Landscape Plan must be put on hold until we have resolved the KM issue. 


There is one other approval that is pending, the demolition permit for the car park unit. I have no qualms stating openly that I will fight to ensure that these 2 permits are not given, until we have resolved the KM issue. 

I am also very disappointed that the Minister for Housing & Local Government can allow a a housing sale license to be issued, when MPSJ's KM approval clearly states hotel suites. Y.B. Dato' Seri Chor Chee Heung must not shy away from taking responsibility for this mistake, and do the necessary, at the very least to suspend the sale license, if not revoke it.

Resolve development order first, says councillor

SUBANG JAYA: The Subang Jaya Municipal Council (MPSJ) is being urged to put on hold all auxiliary submissions on the Dorsett Place Waterfront Development until discrepancies over whether the Mayland Group will be allowed to sell the hotel suites is resolved.
Councillor  Rajiv Rishyakaran called for the move during the council full board meeting on Wednesday after MPSJ’s decision to approve the landscape plans submitted by the developer.
“Why are we approving their landscaping plans when we haven’t resolved the development order with them? We must postpone all decisions until a resolution is found,” he said.
Under the development order, Mayland is allowed to build and renovate 1,989 units of hotel suites in SS12.  
But residents and councillors have objected to the development after the developer advertised to sell these units.
“MPSJ had rejected their previous applications in 2007 and 2009 to build service apartments. Their intention to sell the hotel suites as individual units is akin to selling service apartments but with a different name. We need to resolve this issue before approving any of their auxiliary applications,” he said
Councillor Chang Kim Loong added that the council should set up a special committee to discuss the issue with the architect and planner of the development project.
“We need to resolve this as soon as possible because the people who bought these units are equally confused and we need to give an answer to them,” he said.
MPSJ president Asmawi Kasbi said all these matters will be discussed in a special meeting with representatives from Grand Dorsett Hotel and the developer today (Friday).

EXCLUSIVE: Cycling Routes in Back Lanes Pondered

THE back lanes of SS14 and SS18 in Subang Jaya are being eyed by cycling enthusiasts in the neighbourhood as the next best option to enjoy some track for recreation and activities.
Faced with heavy traffic on the main roads and the lack of space for cycling in existing open spaces in the neighbourhood, folding bike cyclist S.T. Teoh who proposed the idea of utilising the back lanes for recreation said each housing area could provide a minimum of 6km per loop if planned out properly.
“The back lanes of SS14 and SS18 can provide a cycling loop of 6km each. All we need is to map out the loop, mark it and clean it up for use.”
“Back lanes are under-utilised and this is one way for us to use it fruitfully for recreation without incurring too much cost to get it done properly,” he said to SJ Echo.
Teoh said the two loops (SS14 and SS18) could be “connected” to provide the distance and “adventure” cyclists needed for their activities. 
“The two housing areas are connected near the Kesas Highway wall (between SS14/8G-Persiaran Jengka-SS18/1A) and this provides the link between the two areas for a longer distance ride.”
“Families with young children can also come out and cycle together in their neighbourhood. There are slopes along several stretches of SS18 and this will be interesting for many cyclists.”
“Some of the back lanes in SS18 are wide enough to have 4 persons cycling alongside one another. This is the opportunity to bring cycling to everyone’s doorstep,” Teoh added.
He said where cyclists crossed between rows of houses, the local authority could assist by putting up “Bicycle Crossing” signboards to sensitise motorists to the presence of cyclists in the neighbourhood.
In May, Selangor Menteri Besar Tan Sri Abdul Khalid Ibrahim had announced that the State was in the process of identifying bicycle parks in new housing schemes within the Subang Jaya municipality.
Khalid had said Subang Jaya was an ideal place to consider introducing and promoting cycling within the municipality as a means of transportation in the near future.
He had said it was timely to discuss the possibility of having cycling lanes on the roads but it would not be easy to achieve as the roads were never planned to accommodate cyclists.
Teoh said the presence of cyclists in groups could also provide omnipresence in the back lanes and help keep crime at bay, just as they cycled by.
“Residents can identify cycling groups easily because they are normally attired in cycling wear with helmets and they normally cycle together,” he added.
Heavy Tools Cycling Club (HTTC) president Allan Lee who leads a group of 30 cyclists from the neighbourhood was all excited when the proposal was shared with him and several of his members in SS14.
“The idea is very good. If we have this, it will be safer for cyclists and more people will come out to exercise,” he said.
Allan who is a former national bowler said “Cycling helps repair the back of my body and reduces knee aches. Every time I cycle, I manage to ease the pain on my body.”
“I encourage senior citizens to cycle because this is one of the healthiest sports,” said the 71-year-old cyclist.
HTTC member Victor Choo said “I have been staying in Subang Jaya for the past 20 years and I noticed that back lanes are neglected. Some of the back lanes are too dirty but the roads are okay and can be better.”
“With this plan, it will make the community become closer and back lanes will be cleaner. This will make people live healthier and at the same time, it will create a healthy family.” Victor said.
Jeffrey Khoo who cycles in the Subang Jaya and USJ neighbourhood said the proposal was worth considering.
“It’s a good idea as space is lacking for us to cycle on. Subang Jaya has no real tracks. The back lane is a very good option.”  
He said the back lanes could be used by anyone who wanted to cycle without having to be too worried about the traffic around them.
USJ resident Ewe Kim Chew who cycles with his family said cycling in the back lanes would be safer for everyone.
“Many can bring their children cycling and spend quality time together while exercising,” he said.
His 11-year-old son, Jacky Ewe Loong Hwa said having a place to cycle in the neighbourhood will allow him to indulge in the activity with his friends.
“The back lanes are safe enough to cycle in even in the night. All they need to do is clean it up a little bit,” he said.

MPSJ and Police Support Cycling Proposal

THE wheels are in motion to study a proposal by cycling enthusiasts to turn the under-utilised back lanes of SS14 and SS18 in Subang Jaya into cycling lanes for recreation.
MPSJ president Dato Asmawi Kasbi said the idea was excellent and that the council was keen to work with the group to identify the route and the feasibility of immediately implementing the proposal.
“We can clean up the back lanes and even beautify them, apart from considering lighting up the route.”
“I will put together a technical team to meet with the group and start working out the details,” he said.
Asmawi said the council needed the cooperation of residents to help maintain the cleanliness of back lanes.
Subang Jaya OCPD Yahaya Ramli said he welcomed the idea as it would create the presence of cyclists along the back lanes.
“Sixty per cent of house break-ins are perpetrated from the back of the house.”
“This idea of utilising the back lanes for recreation is good as cyclists can also help the police be the ears and eyes on the ground,” he said, when asked on the feasibility of encouraging cycling along the back lanes of houses.
ADUN Subang Jaya Hannah Yeoh said the biggest challenge to the proposal was clearing obstructions in the back lanes and also security concerns.
“Some residents may not want the back of their houses being so accessible, considering some have applied for back lane fencing years ago. “
“MPSJ has undertaken to map this out in new housing areas but for established housing areas, we definitely need to engage the stakeholders first before proceeding further,” she said, adding that if all parties (MPSJ and residents) agreed with the proposal, she could assist in applying for State Government funds to kick start the pilot project.
MPSJ councillor for Zone 3 Dr KM Loi said the proposal was an excellent idea to provide more cycling tracks and facilities for residents.
He said the stumbling block would be gated and guarded schemes in the neighbourhood which might limit access to back lanes for cycling.
MPSJ councillor for Zone 1 Rajiv Rishyakaran said he supported the idea to kick off with back lanes in SS14 and SS18 to gauge public response before it is rolled out in other areas.

Tony has fought for Selangor water rights which was privatized by the Barisan Nasional government to be returned to the state government. SYABAS has sued Tony for defamation and the High Court has awarded RM200,000 in damages with costs to SYABAS. Tony has appealed the judgment to the Court of Appeal but he has been asked to pay the damages to SYABAS first.
